A Sett\u00adle\u00adment has been rea\u00adched in a class action lawsu\u00adit against Micro\u00adsoft on behalf of con\u00adsu\u00admers and busi\u00adnesses that acqui\u00adred Micro\u00adsoft soft\u00adware from May 18, 1994 through Decem\u00adber 31, 2004 for use in New York Sta\u00adte. The poten\u00adti\u00adal value of the Sett\u00adle\u00adment, if all eli\u00adgi\u00adble Class Mem\u00adbers made a cla\u00adim, is esti\u00adma\u00adted to be appro\u00adxi\u00adm\u00adate\u00adly $350 million.

Who Can File Claims?<\/p>\n

All per\u00adsons or enti\u00adties who, from and inclu\u00adding May 18, 1994 through Decem\u00adber 31, 2004, indi\u00adrect\u00adly acqui\u00adred (purcha\u00adsed) a licen\u00adse for use in New York and not resa\u00adle for:<\/p>\n

What Does the Sett\u00adle\u00adment Provide?<\/p>\n

If appro\u00adved by the Court, the Sett\u00adle\u00adment will pro\u00advi\u00adde cash vou\u00adch\u00aders to be used for the purcha\u00adse of com\u00adpu\u00adters, peri\u00adphe\u00adral com\u00adpu\u00adter hard\u00adware (like prin\u00adters or scan\u00adners) or com\u00adpu\u00adter soft\u00adware made by any manu\u00adfac\u00adtu\u00adrer. The vou\u00adch\u00aders are worth:<\/p>\n

o $12 for each Micro\u00adsoft Win\u00addows 95, Win\u00addows 98, Win\u00addows 98 Second Edi\u00adti\u00adon or Win\u00addows Mill\u00aden\u00adni\u00adum ope\u00adra\u00adting system soft\u00adware license;<\/p>\n

o $5 for each Microsoft's MS-DOS<\/span> and Win\u00addows ver\u00adsi\u00adons 1.0 to 3.11, Win\u00addows for Work\u00adgroups, Win\u00addows NT<\/span> Work\u00adsta\u00adtion, Win\u00addows 2000 Pro\u00adfes\u00adsio\u00adnal, Win\u00addows XPPro\u00adfes\u00adsio\u00adnal and Win\u00addows XP<\/span> Home Edi\u00adti\u00adon licen\u00adse; and<\/p>\n

Soft\u00adware purcha\u00adsed for ser\u00adver com\u00adpu\u00adters and Apple com\u00adpu\u00adters is not eligible.<\/p>\n

You are entit\u00adled to cla\u00adim the spe\u00adci\u00adfi\u00aded amounts for each copy of the com\u00adpu\u00adter soft\u00adware you lawful\u00adly acqui\u00adred. Busi\u00adnesses who licen\u00adsed their soft\u00adware on a \"volu\u00adme\" basis may sub\u00admit claims for each com\u00adpu\u00adter their volu\u00adme licen\u00adse aut\u00adho\u00adri\u00adzes them to use in con\u00adjunc\u00adtion with the soft\u00adware listed abo\u00adve. o If you acqui\u00adred up to five copies of qua\u00adli\u00adfy\u00ading Micro\u00adsoft pro\u00adducts, you can use a Stan\u00addard Cla\u00adim Form and you do not have to pro\u00advi\u00adde any addi\u00adtio\u00adnal docu\u00adments or pro\u00adof of purcha\u00adse. You may also sub\u00admit a cla\u00adim online on or befo\u00adre Octo\u00adber 18, 2006.<\/p>\n

o If you are not a volu\u00adme licen\u00adsee and have more than 5 licen\u00adses, you can also use a Stan\u00addard Cla\u00adim Form but you will need to pro\u00advi\u00adde addi\u00adtio\u00adnal information.<\/p>\n

What are Your Options?<\/p>\n

If you don't exclude yours\u00adelf, you have the right to object to any aspect of the Sett\u00adle\u00adment. Your objec\u00adtion must be filed in wri\u00adting by May 18, 2006.<\/p>\n

The Court has appoin\u00adted att\u00ador\u00adneys to repre\u00adsent you. They will seek att\u00ador\u00adneys' fees of $23.5 mil\u00adli\u00adon plus rea\u00adsonable costs. The amount paid to Class Coun\u00adsel will be paid sepa\u00adra\u00adte\u00adly and will not affect the value of the vou\u00adch\u00aders available to the Class.
